Terms of service

Last updated: 5 May 2026

These terms govern your use of Nyuchi Identity (the “Service”), operated by Bundu Foundation, a Zimbabwe company limited by guarantee (“Bundu Foundation CLG”, “we”). By using the Service you agree to these terms. [placeholder: confirm trading name and registration number with legal team.]

Acceptance

By creating an account, signing in, or otherwise accessing the Service you accept these terms and our privacy policy. If you do not agree, do not use the Service.

Eligibility and age

You must be at least [placeholder: minimum age — likely 16 for browse-only, 18 for full KYC and MukokoID]. If you create an account on behalf of a child within your family entity, you confirm you are their parent or legal guardian and accept these terms on their behalf.

Account responsibility

You are responsible for activity that occurs under your Mukoko ID, including keeping your sign-in credentials and any connected device secure. Notify us promptly at support@nyuchi.com if you suspect unauthorised access. We may suspend an account where we believe such notification is overdue.

Acceptable use

You agree not to:

  • impersonate another person or misrepresent your affiliation;
  • submit forged, altered, or otherwise fraudulent KYC documents;
  • scrape, reverse engineer, or interfere with the Service's normal operation;
  • use the Service to facilitate unlawful activity;
  • [placeholder: additional clauses per legal review].

MukokoID and on-chain identity

A MukokoID is an immutable identity token issued on the Mukoko Web3 layer once your Nyuchi profile has been verified. By requesting a MukokoID you authorise us to publish a minimal set of identity claims to the underlying ledger.

Because the underlying token is immutable, revocation is performed by burn rather than edit: a revoked MukokoID is permanently invalidated and a fresh one must be minted to replace it. We may burn a MukokoID where required by law, where the underlying account is terminated for cause, or where the holder requests revocation. [placeholder: legal team to confirm burn-versus-update language and any cross-chain implications.]

Termination

You may close your Nyuchi account at any time from /settings/privacy. We may suspend or terminate access where you breach these terms, where required by law, or where the Service is discontinued. Audit-log records may be retained after termination to the extent required by law or for fraud prevention.

Disclaimers and warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, nor that any defect will be corrected. [placeholder: insert any statutory consumer-protection carve-outs required under Zimbabwean and regional law.]

Limitation of liability

To the maximum extent permitted by law, Bundu Foundation will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for direct damages is capped at [placeholder: cap amount or fee-paid formula].

Governing law

These terms are governed by the laws of Zimbabwe. The courts of Zimbabwe will have exclusive jurisdiction over any dispute arising out of or in connection with them, save that we may bring proceedings against you in the courts of the country in which you reside where required to enforce these terms.
